Preamble

These Sales Terms (hereinafter "Sales Terms") govern the contractual relationships between AURELIA.JOBS and its Clients in the context of the sale of Services offered on the Aurélia.jobs platform.

They supplement the Terms of Use and apply to the exclusion of all other conditions, including those of the Client.

1. Seller Identification

AURELIA.JOBS, a simplified joint-stock company with sole shareholder (SAS) registered with the Thonon-les-Bains Trade and Companies Register under number 998 965 164 (SIRET 998 965 164 00010). 2. Definitions

  • Client: Any legal entity subscribing to Aurélia.jobs Services.
  • Services: The Aurélia.jobs platform services offered in the form of subscriptions.
  • Subscription: Subscription to a pricing plan giving access to Services for a specified period.
  • ToU: The Terms of Use of Aurélia.jobs.

3. Purpose and Scope

These Sales Terms define the conditions of sale for the Services offered by AURELIA.JOBS via the Aurélia.jobs platform.

They apply to any Client wishing to subscribe to the Services, to the exclusion of any other conditions.

4. Services Offered

AURELIA.JOBS offers the following Services through subscription plans:

4.1. General Description

The Services include access to the Aurélia.jobs platform, an artificial intelligence solution for optimizing recruitment processes, including:

  • Smart briefing and needs definition
  • AI-assisted interview preparation
  • CV analysis and scoring
  • Informed decision support
  • Candidate communication tools

4.2. Subscription Plans

The Services are offered as subscription plans whose detailed characteristics (features, number of users, analysis volume, etc.) are available on the platform at the time of subscription.

AURELIA.JOBS reserves the right to modify the subscription plan offering with one month's notice to existing Clients.

5. Pricing Terms

5.1. Prices

Service prices are those in effect on the order date, as displayed on the Aurélia.jobs platform.

Prices are expressed in euros, excluding taxes (VAT) for professional clients subject to VAT.

5.2. Price Revision

AURELIA.JOBS reserves the right to modify its prices at any time. Any price modification will be notified to the Client with a minimum of one month's notice and will apply upon subscription renewal.

In case of price increase, the Client may terminate their subscription before the new rate takes effect.

5.3. Billing

Invoices are issued and transmitted electronically to the Client's email address.

Monthly subscription: Monthly billing in advance
Annual subscription: Annual billing in advance

6. Order Conditions

6.1. Order Process

Orders are placed directly online on the Aurélia.jobs platform according to the following process:

  1. Selection of subscription plan
  2. Creation of Client account
  3. Entry of billing information
  4. Acceptance of Sales Terms and ToU
  5. Online payment
  6. Order confirmation by email

6.2. Order Validation

The order is definitively accepted only after payment confirmation by our payment provider.

6.3. Free Trial

A 30-day free trial is offered, without requiring payment information. At the end of the trial period, access to the Services is suspended until the Client subscribes to a paid plan: no paid subscription is activated automatically.

7. Payment Terms

7.1. Payment Methods

Payment is made:

  • By credit card via our secure payment provider Stripe
  • By bank transfer upon request for annual subscriptions

7.2. Payment Security

Payments are secured by our provider Stripe, PCI DSS certified. YOOMKY does not store any banking data.

7.3. Payment Due Date

Payment is due immediately upon order.

For renewals, payment is automatically processed on the subscription due date.

8. Payment Default

In case of payment default at due date:

  • Access to Services is immediately suspended
  • Late payment penalties of 3 times the legal interest rate apply
  • A fixed compensation of 40 euros for recovery costs is due
  • AURELIA.JOBS may terminate the subscription as of right after formal notice remains unsuccessful for 8 days

9. Delivery and Performance

9.1. Service Activation

Access to Services is activated immediately after payment confirmation.

9.2. Availability

AURELIA.JOBS undertakes to ensure Service availability under the conditions defined in the ToU.

10. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content whose performance has begun with the Client's prior express agreement.

By accepting immediate activation of Services, the Client expressly waives their right of withdrawal.

11. Warranties

11.1. Conformity Warranty

AURELIA.JOBS warrants that the Services provided conform to the announced technical specifications.

11.2. Warranty Limitation

AURELIA.JOBS does not guarantee:

  • Absolute accuracy of AI analyses provided
  • Perfect adequacy of results to Client expectations
  • Absence of service interruption due to external causes

12. Liability and Limitations

12.1. Liability Limitation

AURELIA.JOBS's liability is limited to direct damages and cannot exceed the amount paid by the Client for the annual subscription.

12.2. Liability Exclusion

AURELIA.JOBS cannot be held liable for:

  • Indirect damages (loss of profit, opportunity, etc.)
  • Use of Services by the Client
  • Recruitment decisions made by the Client

13. Termination

13.1. Termination by Client

The Client may terminate their subscription at any time with effect at the end of the current period.

13.2. Termination by AURELIA.JOBS

AURELIA.JOBS may terminate the subscription in case of serious breach by the Client of their obligations.

13.3. Consequences of Termination

No refund is made for the current subscription period.

14. Data Protection

The processing of personal data is governed by our Privacy Policy, available on the platform.

15. Intellectual Property

The Services and Aurélia.jobs platform are and remain the exclusive property of AURELIA.JOBS.

The Client benefits from a non-exclusive usage right limited to the duration of their subscription.

16. Force Majeure

AURELIA.JOBS cannot be held liable for non-performance of its obligations in case of force majeure within the meaning of Article 1218 of the French Civil Code.

17. Miscellaneous Provisions

17.1. Entirety

These Sales Terms and the ToU constitute the entire agreement between the parties.

17.2. Partial Invalidity

If a clause is declared null, the other clauses remain in effect.

17.3. Modification

The Sales Terms may be modified by AURELIA.JOBS with one month's notice.

18. Governing Law and Jurisdiction

These Sales Terms are governed by French law.

Any dispute falls under the jurisdiction of the Commercial Court of Thonon-les-Bains.
